Terms and Conditions


Seller

The provider of products and services sold in this online store is Näkkälä Adventures, (1566391-5), and these terms and conditions apply to the offering of products and services.

Terms of Service

The Näkkälä Adventures follows the following terms regarding orders, reservations and cancellations of services. These terms shall be binding to both parties when the Customer has paid the payment mentioned in these contractual terms.

Customer Responsibility

Snowmobile safari

The driver of the snowmobile has to be min. 18 years old and poses a valid full driver’s license for cars. Please note that drivers need to be able to show the driving license during the safari if requested. All snowmobile safaris include the use of snowmobile, fuel, thermal outfit, maintenance, insurance (maximum personal liability Euro 1.000) and guide service.

Accomodations

The Customer is obliged to compensate directly to us for all possible damages caused by the Customer to the apartment or cottage or its property including all related evaluation and handling fees.

Smoking is strictly forbidden in all apartments and cottages. For smoking inside, we will charge 1.000€.

The maximum number of persons allowed to stay in the apartment is the same as the number of beds stated in the cabin description, and this number may not be exceeded. If the number of persons staying in the cabin is more than the number of beds stated in the description, we has right to charge extra fee of 20% of the cabin rent price or has right to terminate the contract during the stay. If the contract is terminated for above mentioned reason, the Customer is not entitled to a rent refund. The use of tent, caravan or mobile home, or use of rentable equipment such as hot tubs without the express permission of the Näkkälä Adventures, as well as charging of electric and hybrid cars is strictly forbidden.

The customer is responsible for damages caused intentionally or negligently by the customer to the seller or third parties.

Cancellation and Modification

Service provider’s right to cancel the reservation

In case of force majeure Näkkälä Adventures has the right to cancel the reservation. In this case the client has a right to be refunded to the full. The reservation can be cancelled without a notification to the client if payments or deadlines are not met. If the accommodation or activity has to be cut short due to unwelcome behaviour, the refund does not apply. We hold the right for changes in timetables and the order of the programs. All programs can also be varied or cancelled due to the weather or other safety reasons. Näkkälä Adventures hold the right to cancel or rearrange the service due to the COVID restrictions by the officials until one day before the service day. Näkkälä Adventures reserves the right to alter any tour due to weather conditions or the safety of the customers. We also reserve the right to change prices. Prices include V.A.T.

 

Activity Cancellation costs

Up to 8 days before arrival, cancellation cost is 20% of the rate.

Less than 7 days before arrival or no show, cancellation cost is 100% of the rate. 


Accomodation cancellation costs

Up to 30 days before arrival, cancellation cost is 50€.

Less than 30 days before arrival, cancellation cost is 100%.

Force Majeure

Näkkälä Adventures shall not be liable for the cancellation of an order or reservation or other damage resulting from a force majeure event beyond Näkkälä Adventures's control, which the seller could not reasonably have foreseen at the time of the transaction and the consequences of which Näkkälä Adventures could not reasonably have avoided or overcome.

Notices and Complaints

The terms and conditions of Näkkälä Adventures apply for all bookings. In case of disagreements, the parties shall first and foremost attempt to resolve any disputes arising from this agreement via bilateral negotiations. If no reconciliation is achieved as a result of such negotiations, the disputes shall be settled by the district court of Näkkälä Adventures’s domicile. 

Complaints

All complaints regarding the reservation or condition of the apartment shall be made immediately to the Näkkälä Adventures. Complaints made afterwards will not be considered by Näkkälä Adventures.

Should there be any repair- or maintenance work done at the holiday-home, for reasons not connected to us or any other unforeseeable reason, and the problem is fixed within an adequate time span, Näkkälä Adventures may not be held liable to pay compensation.

 


Applicable Law and Dispute Resolution

The parties shall endeavor to resolve disputes arising from the agreement primarily through negotiations. If no agreement is reached in negotiations, disputes shall be settled in the district court of the seller's domicile. This agreement is governed by Finnish law.

This online store has been implemented on the Joiku Booking online store platform. Joiku Booking (Comgate Oy, 2663001-9) does not provide, own, or control any services or products such as accommodations, activities, or transportation services that you access through this site.

The owner of this online store, Näkkälä Adventures, owns, controls, or offers services or products directly or as an agent. The seller is responsible for the service or product sold. The seller's terms apply to your booking, so you must accept and understand these terms. Joiku Booking is not responsible for any issues related to booking, use, implementation, or delivery of the service or product.

Ordering

Products are primarily ordered through the internet via the online store's shopping cart.

All orders will be confirmed via email, indicating the order price and ordered items. To receive the order confirmation, provide your email address during the order process.

By placing each order, you agree to the current seller's terms of service.

Payment Methods

The following payment methods are available in the online store: Nordea, Osuuspankki, Danske Bank, Alandsbanken, Handelsbanken, S-Pankki, Aktia, Säästöpankki, POP Pankki, Oma Säästöpankki, Visa, MasterCard, American Express. Payment is processed through the Paytrail Oyj website.

Payment Service Provider

Paytrail Oyj (2122839-7) acts as the payment intermediary and provider in cooperation with Finnish banks and credit institutions. Paytrail Oyj will appear as the payee on your account statement or credit card bill and will transmit the payment to the merchant. Paytrail Oyj holds a payment institution license.

Order and Payment Confirmation

You will receive an order confirmation by email, including:

  • List of ordered products
  • Total invoice amount
  • Tax breakdown
You will receive a payment confirmation from Paytrail Oyj, including the payment amount, payment reference, and date. In case you have any questions regarding the payment transaction, please primarily contact the seller. You can also contact Paytrail (020 718 1830 / [email protected]).

Should there be any inconsistency or conflict between the English and Finnish versions of the Terms and Conditions, the Finnish version shall prevail.
